1. Not Financial Advice

Exodus Algo (the "Service") is a software service that automates the execution of trades on accounts you choose to link. We are not a registered investment advisor, broker-dealer, commodity trading advisor (CTA), commodity pool operator (CPO), introducing broker, financial planner, or licensed professional of any kind. Nothing on this website, in our communications, or in the operation of the Service constitutes investment advice, financial advice, trading advice, tax advice, legal advice, or any other type of professional advice. You are solely responsible for any decision to subscribe to the Service and to authorize it to place trades on your behalf.

2. No Income or Profit Guarantees

We make no representation, warranty, or guarantee — express or implied — that the use of Exodus Algo will result in profits, will avoid losses, or will achieve any particular outcome. Any references to profits, returns, performance, or outcomes — whether explicit, implied, hypothetical, illustrative, or shown in examples (including, without limitation, any high-water mark or fee example shown on our marketing pages) — are for educational purposes only and are not guarantees, projections, or representations of actual or expected future performance. Trading futures is highly speculative; you may lose some or all of the capital in your account, and in certain circumstances your losses may exceed your initial deposit.

3. Futures Trading Risk Disclosure

The risk of loss in trading commodity futures, options on futures, and other leveraged products can be substantial. Before deciding to trade, you should carefully consider your investment objectives, level of experience, financial resources, risk tolerance, and other relevant circumstances. You should only trade with risk capital — money you can afford to lose entirely without affecting your lifestyle, financial security, or wellbeing. Leverage can work against you as well as for you and can lead to large losses as well as gains. Futures trading is not appropriate for all investors.

4. Hypothetical Performance Disclaimer (CFTC Rule 4.41)

Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.

5. Past Performance Is Not Indicative of Future Results

Past performance — whether actual, simulated, back-tested, or shown by way of illustration — is not necessarily indicative of future results. Market conditions, volatility, liquidity, and other factors change continuously, and an algorithm or strategy that performed well in the past may not perform well in the future, or may produce significant losses. No statement on this site or in any communication should be construed as a promise or guarantee that future performance will replicate past performance.

6. User Responsibility & Acknowledgments

By linking your Tradovate account to Exodus Algo and subscribing to the Service, you acknowledge and agree that:

  • You retain full ownership and control of your trading account and the funds in it; we never take custody of your money.
  • You can disable trade copying at any time using the master kill switch in your dashboard.
  • You are responsible for monitoring your account and the activity placed in it by the Service.
  • You are responsible for understanding and complying with the rules, terms, and risk parameters of any prop firm, broker, exchange, or third-party platform you connect.
  • You are responsible for any taxes, fees, regulatory obligations, or reporting requirements arising from your trading activity.
  • You have read and understood the risks of futures trading and you are subscribing to the Service of your own free will.

7. Service Availability & Technical Limitations

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted operation, freedom from errors, or that every signal will be successfully transmitted to your broker. Outages, technical failures, broker rejections, network issues, exchange halts, third-party API limitations, software bugs, and circumstances beyond our control may delay, prevent, partially execute, or duplicate trades. We are not responsible for losses, missed gains, or other damages resulting from such events. You should not rely on the Service as your sole means of trade execution or risk management.

8. No Fiduciary or Advisory Relationship

Use of Exodus Algo does not create any agency, fiduciary, advisory, brokerage, or trustee relationship between you and Exodus Algo or any of its operators, owners, employees, or affiliates. We do not act on your behalf in any capacity beyond the technical execution of orders generated by our automated software. You should consult an appropriately licensed financial advisor, registered investment professional, accountant, attorney, or tax professional before making any decision affecting your finances.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Exodus Algo and its operators, owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, lost profits, lost data, lost opportunity, or trading losses — arising out of or in any way related to your use of, inability to use, or reliance on the Service, regardless of the legal theory under which such damages are sought, even if we have been advised of the possibility of such damages. Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue use and cancel your subscription.

10. Indemnification

You agree to defend, indemnify, and hold harmless Exodus Algo and its operators, owners, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your violation of these disclosures or any applicable law; (c) any trading activity placed on your linked accounts; or (d) any third-party claim arising out of your conduct.

11. Testimonials & Examples

Any testimonials, screenshots, charts, account statements, or examples shown on this website or in our communications are not necessarily representative of all subscribers and do not guarantee that any other subscriber will achieve the same or similar results. Individual outcomes vary based on capital, market conditions, account configuration, and many other factors outside our control.

12. Eligibility & Jurisdiction

You represent that you are at least 18 years old (or the age of legal majority in your jurisdiction), have the legal capacity to enter into a binding agreement, and are not located in or a resident of any jurisdiction in which use of the Service would be prohibited or restricted by applicable law. You are responsible for ensuring that your use of Exodus Algo complies with all laws, regulations, and rules applicable to you.

13. Subscription, Performance Fee & Cancellation

Subscription to the Service consists of (a) a recurring monthly platform fee of $99.95 USD, billed via PayPal, and (b) a performance fee equal to 20% of new realized profits generated in your linked accounts during each two-week billing window, calculated using a high-water-mark methodology and recorded in your subscriber dashboard. The performance fee is only assessed on profits above your previous high-water mark; no fee is owed during periods of net loss or recovery. You may cancel your monthly subscription at any time through PayPal or your dashboard. Cancellation halts new fee accruals from the date of cancellation but does not waive any performance fees already earned and recorded prior to cancellation.

14. Modifications

We may update these disclosures from time to time. Material changes will be reflected on this page with an updated "Last updated" date. Your continued use of the Service after any update constitutes acceptance of the revised disclosures.

15. Governing Law

To the extent not preempted by U.S. federal law, these disclosures and any dispute arising out of or related to them or to your use of the Service shall be governed by the laws of the State of Delaware, without regard to its conflict-of-laws provisions. Any such dispute shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

16. Acknowledgment

By subscribing to and using Exodus Algo, you acknowledge that you have read, understood, and agreed to all of the disclosures, disclaimers, and risk warnings on this page, and you accept full responsibility for any and all outcomes — including financial losses — that may result from your use of the Service.
